Foreign Freehold Condos in Phuket

For many international buyers, condos for sale in Phuket offer one of the clearest routes to direct property ownership in Thailand, subject to the applicable foreign ownership rules.

Qualifying foreign buyers may own condominium units in their own name under foreign freehold ownership, subject to the foreign ownership quota of the registered condominium building.

Under Thailand’s condominium framework, foreign ownership is generally limited to 49% of the total unit area of a registered condominium. Before purchasing a resale unit, buyers should therefore confirm that foreign quota remains available and that the unit can actually be transferred as foreign freehold. Thailand’s official government guidance provides further information on foreign condominium ownership in Thailand.

The ownership structure should always be confirmed before a reservation, deposit or purchase agreement is treated as final.

JFTB helps buyers distinguish between foreign freehold, Thai freehold and leasehold opportunities and coordinates with independent legal professionals where formal verification is required.

Resale vs New Development Condos in Phuket

Condos for sale in Phuket can broadly be divided between resale properties and units in new or off-plan developments.

Neither option is automatically better.

A resale condominium allows the buyer to inspect the actual unit, building, common areas and surrounding neighbourhood before committing. Management quality, occupancy, maintenance standards and the existing resale market can also be easier to assess.

Resale units may additionally offer larger floor plans or locations where little new land remains available.

New developments can offer modern design, new facilities, staged payment schedules and a wider choice of units during the early sales period.

However, off-plan buyers should look beyond renderings and launch promotions.

Developer track record, construction progress, contractual terms, projected completion, common area plans and the amount of competing supply should all be considered.

The correct choice depends on the buyer’s priorities, holding period, risk tolerance and intended use of the property.

Buyers comparing condos for sale in Phuket should look beyond asking price and consider ownership status, building quality, management and future resale competition.

What to Check Before Buying a Condo in Phuket

A condominium purchase should not be evaluated solely on price per square metre or the appearance of the unit.

Important questions can include:

  • Ownership status. Is the unit genuinely available under foreign freehold, or is it Thai freehold or leasehold?
  • Foreign ownership quota. Is sufficient quota available at the condominium for the proposed transfer?
  • Title and documentation. Do the ownership documents correspond with the unit being purchased?
  • Building management. Is the condominium juristic person functioning effectively and maintaining the property?
  • Common area condition. Are the pool, lifts, corridors, parking areas and other facilities being properly maintained?
  • Common fees and sinking fund. What are the current charges, and are there any known special assessments or major future expenses?
  • Rental restrictions. Does the building allow the type of rental activity the buyer intends?
  • Developer or project history. For new projects, what information is available about previous developments and delivery?
  • Resale liquidity. How much comparable inventory is available in the same building or immediate area?

JFTB helps identify these commercial questions before the buyer commits significant funds.

For the wider transaction framework, see our Property Due Diligence in Thailand guide.

Foreign Ownership Quota

The foreign ownership quota is one of the most important differences between buying a condominium and buying other forms of property in Thailand.

A unit being advertised as a condominium does not automatically mean that it can be transferred to a foreign buyer under foreign freehold ownership.

Quota availability needs to be checked.

In established buildings, this can also affect future resale. A foreign freehold unit may appeal to a different buyer pool from a Thai freehold or leasehold unit in the same development.

For international buyers comparing several condos for sale in Phuket, ownership status should therefore be identified early rather than after negotiations have already started.

Common Area Fees, Sinking Funds and Building Management

The cost of owning a condo does not stop at the purchase price.

Most developments charge recurring common area fees to fund the maintenance and operation of shared facilities such as security, swimming pools, lifts, landscaping, common lighting and building staff.

Many condominiums also maintain a sinking fund intended for larger capital expenses.

The amount charged is only part of the issue.

Buyers should also look at how well the building is maintained, whether major repairs appear to have been postponed and whether the management structure seems capable of protecting the long-term condition of the property.

A building with impressive facilities can become expensive if those facilities require substantial maintenance without adequate financial planning.

Conversely, strong management and well-maintained common areas can support both rental appeal and resale value.

Rental Rules and Management

A condominium bought for personal use and a condominium bought primarily for rental income should be evaluated differently.

Buyers planning to rent their unit should understand the building’s rules, the management structure and the type of rental demand in the surrounding area.

Some developments are better suited to long-term residents. Others attract holidaymakers, seasonal visitors or owners who use their property only part of the year.

Advertised rental projections should not be treated as guaranteed returns.

Management fees, vacancy, maintenance, furnishing replacement and competing supply can all affect actual performance.

JFTB compares available market evidence and the characteristics of the specific building rather than relying only on promotional yield figures.

Best Areas for Condos in Phuket

The location of condos for sale in Phuket can materially affect rental demand, resale liquidity and long-term value.

Phuket does not have one single condominium market.

Different areas suit different buyer profiles, budgets and investment strategies.

Patong

Patong offers one of Phuket’s most established tourism markets, with strong lifestyle appeal, nightlife, shopping and a large existing condominium stock.

Location within Patong matters considerably. Walking distance to the beach or central commercial areas can make a significant difference to rental appeal and resale demand.

Bang Tao and Laguna

Bang Tao, Laguna and the wider Cherng Talay area have attracted substantial residential and hospitality development.

The area appeals to lifestyle buyers, families, investors and longer-stay residents, but buyers should compare new supply carefully when evaluating future resale competition.

Kamala

Kamala offers a quieter environment than Patong while maintaining strong access to the west coast.

The market includes both lifestyle condominiums and higher-end developments, with substantial differences in positioning and pricing.

Kata and Karon

Kata and Karon remain established resort markets with strong beach appeal and a mix of resale and newer condominium developments.

They can suit both lifestyle buyers and investors, but building quality and location vary significantly.

Rawai and Nai Harn

Southern Phuket, Rawai and Nai Harn attracts residents, retirees, repeat visitors and longer-stay international buyers.

Condos in Rawai and Nai Harn can provide an alternative to the more tourism-driven west coast markets.

Phuket Town

Phuket Town appeals more strongly to residents and longer-term occupants than traditional beach tourists.

It can offer lower entry pricing than the premium west coast areas, although the buyer profile and rental market are different.

Phuket Condo Investment Considerations

Price per square metre is useful, but it should not be the only measure used to compare condominium investments.

Two units at similar prices may have very different long-term prospects depending on the building, location, ownership status, view, floor, layout, management and amount of competing inventory.

Investors should consider:

  • realistic rental demand
  • expected operating costs
  • quality of building management
  • foreign freehold status
  • future competing supply
  • resale buyer profile
  • unit layout and usability
  • location within the project
  • access to beaches, services and infrastructure

A high advertised rental yield can be less attractive if the property has weak resale liquidity or unusually high operating expenses.

Likewise, a lower-yielding foreign freehold condominium in a strong location may offer a different balance between income, personal use and long-term resale potential.

There is no universal formula.

The correct condominium depends on what the buyer wants the property to achieve.

Why Work With JFTB for a Phuket Condo Purchase?

JFTB Real Estate Phuket has worked with international property buyers in Phuket since 2013.

Our approach is not limited to presenting available listings.

JFTB evaluates Phuket condos for sale from both a lifestyle and investment perspective, depending on the buyer’s objectives.

For condominium buyers, JFTB can help with:

  • identifying suitable resale and new-development opportunities
  • comparing locations and projects
  • understanding foreign freehold, Thai freehold and leasehold structures
  • assessing pricing against relevant alternatives
  • examining rental and resale considerations
  • negotiating price and commercial terms
  • identifying matters requiring further investigation
  • coordinating with independent lawyers and other specialists
  • supporting the transaction through to completion

JFTB is not a law firm and does not replace independent legal advice.

Our role is to help clients understand the property and the commercial transaction, identify the questions that need to be answered and coordinate specialist advice where required.

An attractive condo should still make sense after its ownership structure, operating costs, management and resale market have been examined.
