It primarily targets qualifying residential rental business operators offering three or more residential units for rent, whether those units are located in one building or across several properties.

For landlords, tenants and investors in Phuket, this distinction matters because the legal treatment of a private owner renting one condominium can differ significantly from that of an operator renting several units as a business.

This guide explains the main Thailand rental rules in force in 2026 and how they affect practical rental situations in Phuket.

It provides general information only. Individual lease, ownership, immigration and tax matters should be reviewed by qualified Thai legal or tax professionals where appropriate.

Understanding Thailand rental law is therefore essential before relying on a standard lease template

For clients primarily looking for accommodation, see properties for rent in Phuket.

Thailand Rental Law 2026: What Changed Under the OCPB Rules?

The Contract Committee under Thailand’s Office of the Consumer Protection Board introduced a new notification governing residential property leasing as a controlled-contract business.

The notification was published in the Government Gazette on 6 June 2025 and took effect on 4 September 2025.

One of its most significant changes was reducing the qualifying threshold from five residential units to three.

The regime can cover houses, condominium units, apartments, rooms and other residential accommodation where the lessor qualifies as a regulated rental business operator.

Registered hotels and dormitories governed by separate legislation are excluded.

Another important change is that the rules expressly extend to qualifying residential lease contracts concluded through online platforms.

Contracts entered into under the previous 2019 notification remain valid until their expiry, while qualifying contracts executed from 4 September 2025 onward must comply with the new framework.

The Office of the Consumer Protection Board continues to oversee residential contract compliance and issues guidance relevant to landlords and tenants.

Who Is Covered by the OCPB Residential Rental Rules?

The key question is not simply whether a property is rented.

The first question is whether the landlord qualifies as a residential rental business operator under the controlled-contract notification.

Landlords Offering Three or More Residential Units

The regulated regime can apply where a lessor offers at least three residential units for rent.

The properties do not have to be located in the same building or development.

An operator renting three condominium units in three different Phuket developments can therefore potentially fall within the regime if the other legal conditions are satisfied.

This is particularly relevant to investors who have accumulated several rental properties over time.

Private Owners With One or Two Units

A private owner renting one or two residential properties does not fall within the OCPB controlled-contract regime solely because those properties are rented.

That does not mean the lease is unregulated.

Thailand’s Civil and Commercial Code, contractual principles and other applicable laws still apply.

The distinction is important because online advice frequently presents OCPB rules as though they applied identically to every landlord in Thailand.

They do not.

Hotels and Other Regulated Accommodation

Registered hotels and certain dormitories operate under separate regulatory regimes.

Short-term tourist accommodation can also involve hotel licensing, condominium regulations and other requirements that differ from an ordinary residential tenancy.

For more detail, see our guide to short-term rentals in Phuket.

Do the Rules Protect Foreign Tenants?

The OCPB framework is intended to protect consumers using residential rental services and is not limited simply because a tenant is foreign.

Foreign tenants in Phuket should nevertheless distinguish contractual rental rights from immigration obligations.

These are separate legal issues.

One particularly important example is Thailand’s TM30 reporting requirement, discussed later in this guide.

What Must a Regulated Residential Lease Contain?

The 2025 controlled-contract rules impose specific requirements on qualifying rental businesses.

The lease should clearly identify the parties, the rented property, lease duration, rent, payment dates, service charges, utilities, security deposit and advance rent.

The condition of the property at the beginning of the tenancy should also be documented.

A significant requirement is that regulated residential lease contracts must contain clearly legible Thai-language text.

Under the 2025 notification, the Thai text must generally be at least two millimetres in size and meet the applicable readability requirements.

This is particularly important in Phuket, where landlords and foreign tenants frequently rely on English-only lease templates.

A landlord operating three or more qualifying residential units should therefore not assume that an old English-language contract remains compliant.

The practical lesson is simple:

Do not rely on an old generic rental template without checking whether it complies with the current regime.

Why the Move-In Condition Report Matters

A jointly acknowledged move-in condition report can become one of the most important documents in a rental dispute.

It should identify the condition of the property, furniture, appliances and other relevant items when possession is handed to the tenant.

Dated photographs can provide additional evidence.

For landlords, this helps establish whether later damage occurred during the tenancy.

For tenants, it helps prevent pre-existing defects from being deducted from the security deposit.

This is particularly important in Phuket, where villas and condominiums are often rented fully furnished and may include expensive appliances, furniture, pools and other equipment.

Rent, Utilities and Service Invoices

Qualifying operators under the controlled-contract regime must provide written invoices for rent, utilities and applicable service charges at least three days before payment is due.

Tenants should also be able to understand how the amounts have been calculated.

Transparent billing is therefore not simply good property management.

For regulated rental operators, it forms part of the compliance framework.

Security Deposits and Advance Rent

Under Thailand rental law, deposit limits depend first on whether the OCPB controlled-contract regime applies

Deposits are one of the most frequently misunderstood areas of Thailand rental law.

There is no single universal rule stating that every landlord in Thailand can collect only a fixed number of months as a security deposit.

The correct treatment depends first on whether the OCPB controlled-contract regime applies.

Monthly Rental Arrangements

For qualifying short-term contracts and qualifying long-term contracts where rent is paid monthly, the combined amount of the security deposit and advance rent generally cannot exceed three months of rent.

For example, with monthly rent of THB 30,000, the combined regulated amount would generally not exceed THB 90,000.

The important point is that the limit concerns the combined amount of deposit and advance rent.

It should not be described as a universal three-month security-deposit allowance.

Long-Term Contracts With Annual Payments

Certain qualifying long-term agreements where rent is paid annually can follow a different limit.

Under the controlled-contract framework, the combined security deposit and advance rental payment may reach up to one year’s rent in qualifying cases.

A statement such as “Thailand has a universal three-month deposit cap” is therefore inaccurate.

What About a Private Owner Renting One Phuket Condo?

If an individual owner rents a single condominium and does not qualify as a controlled residential rental business operator, the same OCPB thresholds do not automatically govern the lease.

The contract and general Thai law remain relevant.

This is why the landlord’s status should be identified before deciding whether a particular deposit arrangement complies with the controlled-contract rules.

When Should a Security Deposit Be Returned?

For leases covered by the regulated regime, the 2025 rules establish specific principles for returning deposits.

Where no tenant-caused damage exists, the deposit should generally be returned within seven days after the tenancy ends and possession is returned.

Where legitimate tenant-caused damage requires repair deductions, the remaining balance should generally be returned within 14 days after the relevant deductions.

Normal wear and tear should not be treated in the same way as actual tenant-caused damage.

Again, the condition report matters.

Can a Landlord Automatically Keep the Deposit?

A regulated landlord cannot simply confiscate a security deposit because the lease has ended or because a broad forfeiture clause appears in the contract.

Legitimate claims for unpaid obligations or tenant-caused damage are different.

The practical issue is evidence.

A landlord making deductions should be able to explain and document them.

A tenant disputing deductions should retain the lease, inventory, payment records, photographs and relevant communications.

Electricity and Water Charges

Utility charges have been an important area of regulatory attention in Thailand.

Under the controlled-contract regime, regulated rental operators cannot use electricity or water charges as an unrestricted additional source of profit.

Charges should follow the applicable official utility rates and the calculation method should be transparent.

Because electricity and water tariffs can change, landlords should avoid copying old fixed baht-per-unit rates from historical contracts or online templates.

The safer approach is to apply the appropriate provider tariff and clearly explain how the tenant’s charge is calculated.

Other Service Charges

Rental properties can involve additional charges for parking, waste collection, maintenance or other services.

Where the controlled-contract rules apply, these charges should be clearly disclosed rather than introduced after the tenant has moved in.

A useful practical rule is simple:

If the tenant is expected to pay a recurring charge, define it clearly before the lease begins.

Repairs and Maintenance

The 2025 controlled-contract framework also addresses responsibility for repairs.

For qualifying contracts, the lessor is generally responsible for repairs other than minor repairs resulting from normal wear and tear or damage attributable to other legally recognised causes.

A regulated contract should therefore avoid transferring broad responsibility for normal property maintenance to the tenant.

For Phuket villas in particular, leases should clearly distinguish between normal property maintenance, tenant-caused damage and responsibilities relating to pools, gardens, air-conditioning systems and other equipment.

Can Rent Be Increased During the Lease?

The controlled-contract framework restricts clauses allowing a regulated landlord simply to increase rent or covered service charges during an agreed lease term.

The lease should therefore establish the rent and relevant charges clearly from the beginning.

A later renewal is a separate contractual stage and may involve new commercial terms.

However, regulated landlords should also be aware that the 2025 notification prohibits clauses requiring tenants to pay a specific renewal fee merely for extending the contract.

Can a Tenant Leave a Fixed-Term Lease Early?

For qualifying controlled contracts, the 2025 rules provide tenants with a specific early-termination mechanism.

A tenant generally needs to have occupied the property for at least 50% of the agreed lease term, provide at least 30 days’ written notice and have no outstanding rent or other payments.

This should not be interpreted as meaning that every tenant under every private lease in Thailand automatically acquires the same termination right.

The applicable legal regime still needs to be identified first.

Can a Landlord Terminate the Lease?

A regulated landlord’s termination rights are also restricted.

Under the 2025 framework, ordinary termination generally requires at least 30 days’ prior written notice.

Where the tenant’s conduct directly and urgently affects the normal living conditions of other tenants, the required notice can be reduced to at least seven days.

Immediate termination without advance notice is reserved for more serious circumstances involving violations of laws or regulations relating to public order or morality.

Landlords should therefore be cautious about clauses claiming an unrestricted right to terminate a regulated tenancy immediately for any breach.

Mandatory and Prohibited Contract Terms

The OCPB framework does more than simply prohibit certain clauses.

Required provisions that are omitted from a qualifying lease can be treated as incorporated into the contract as implied terms.

Conversely, prohibited clauses can be treated as nonexistent and unenforceable even if the tenant signed the agreement.

Prohibited provisions can include clauses that:

impose deposits or advance rent above applicable limits;

allow rent or service charges to be increased during the agreed term;

permit unjustified confiscation of deposits;

allow entry into the property without proper notice except in emergencies;

impose utility charges above applicable official rates;

permit improper lockouts or removal of the tenant’s belongings;

charge a fee simply for renewing the lease;

make tenants responsible for normal wear and tear; or

give the landlord termination rights where no material tenant breach exists.

A signature alone therefore does not make every provision in a rental contract enforceable.

Penalties for Non-Compliance

For qualifying residential rental businesses, compliance with the controlled-contract regime is not merely a matter of drafting preference.

Failure to comply can expose a business operator to criminal penalties under Thailand’s consumer-protection framework.

Penalties can include imprisonment for up to one year, a fine of up to THB 200,000, or both.

This is particularly relevant to Phuket investors who own or operate three or more residential rental units.

Landlords who may fall within the regulated regime should therefore have their standard lease documentation reviewed rather than continuing to use contracts created under older rules.

Why the Three-Year Lease Rule Matters

The OCPB consumer rules and Thailand’s lease-registration rules deal with different legal issues.

Under Thailand’s ordinary Civil and Commercial Code framework, a lease of immovable property exceeding three years generally needs to be in writing and registered with the competent Land Office if the parties expect the agreed period beyond the first three years to be enforceable.

A private contract describing a five-year, ten-year or twenty-year lease should therefore not automatically be assumed to protect the tenant for the entire stated period if the required registration has not taken place.

This becomes particularly important where a long lease forms part of the economic value of a property transaction.

For a broader explanation of ownership and long-term property structures, see our guide to buying property in Thailand.

What Is the Standard Maximum Lease Term?

Under Thailand’s ordinary Civil and Commercial Code framework, a lease of immovable property is generally limited to 30 years per registered term.

A future renewal can potentially be agreed, but a contractual promise of renewal should not automatically be presented as equivalent to a presently registered 60-year or 90-year lease right.

The legal effect of any renewal arrangement depends on the structure and circumstances.

Buyers considering property marketed using expressions such as “30+30+30” should therefore have the documentation independently reviewed before committing substantial funds.

TM30 Reporting for Foreign Tenants

Rental-contract law is separate from immigration reporting requirements.

Under Section 38 of Thailand’s Immigration Act, the relevant house owner, head of household, landlord or hotel manager accommodating a foreign national who is legally staying in Thailand must generally notify immigration within 24 hours of the foreign national taking up residence.

This notification is commonly known as TM30.

Thailand Immigration provides an online TM30 reporting system for eligible property owners and accommodation operators.

For Phuket landlords renting to foreign tenants, TM30 should therefore be treated as a separate practical compliance obligation in addition to the lease itself.

TM30 reporting is separate from Thailand rental law and falls under immigration legislation.

Short-Term Rentals and Condominium Rules

Short-term accommodation should not automatically be treated in the same way as an ordinary residential lease.

Hotel licensing rules, condominium regulations, building rules and the way accommodation is operated can all affect whether a particular rental activity is permitted.

Condominium owners should also check the condominium’s own regulations, which may restrict daily or other short-duration rentals.

Investors considering holiday-rental income should review these issues before relying on projected nightly rental returns.

See our detailed guide to short-term rentals in Phuket.

Rental Income and Thai Tax

Rental income is generally assessable income under Thailand’s Revenue Code.

For individual landlords, property rental income generally falls within Section 40(5).

The actual tax position depends on factors including whether the landlord is an individual or company, Thai tax residence, the identity of the payer, allowable deductions, withholding requirements and any applicable double-tax treaty.

There is therefore no single universal “Thailand rental tax rate” that accurately describes every landlord’s position.

Standard Expense Deduction for Individual Landlords

Thai Revenue Department guidance provides, subject to the applicable rules, a standard 30% expense deduction for certain income from the letting of houses and buildings.

This percentage is part of the tax calculation.

It should not be confused with the property’s actual operating expenses.

A Phuket property can have very different real costs once common-area fees, maintenance, repairs, insurance, management, vacancy periods, pool and garden maintenance and other expenses are considered.

Taxable income and actual investment return should therefore be analysed separately.

For a broader tax overview, see Thailand property taxes for foreign buyers.

Non-Resident Landlords and Withholding Tax

Thailand’s Revenue Code provides for 15% withholding in specified circumstances when income falling under Sections 40(5) and 40(6) is paid to a non-resident taxpayer.

Rental income can fall within Section 40(5).

This does not necessarily mean that 15% represents the landlord’s final tax liability in every situation.

Tax residence, filing obligations, treaty provisions and the particular payment structure can affect the final position.

Foreign property owners receiving rental income in Thailand should therefore obtain professional tax advice based on their own circumstances.

Who Pays the Rent Can Also Matter

Withholding mechanisms can differ depending on the identity of the payer.

For example, rent paid by a Thai company can create withholding obligations that differ from a straightforward private residential payment.

Landlords should therefore avoid relying on simplified statements such as “rental tax is X%”.

The taxpayer, payer, lease structure and payment method all matter.

Stamp Duty on Lease Agreements

Lease agreements can also be subject to Thai stamp duty.

According to the Thai Revenue Department’s stamp-duty schedule, rental of land, buildings and certain other immovable property is generally subject to stamp duty of THB 1 for every THB 1,000, or fraction thereof, of the rent or key money payable over the entire lease period.

The precise treatment of a particular agreement should be confirmed where material, especially for substantial or long-term leases.

Is Residential Rent Subject to VAT?

The letting of immovable property is generally treated as VAT-exempt under relevant provisions of Thailand’s Revenue Code.

That does not necessarily mean that every service supplied alongside accommodation receives identical VAT treatment.

Serviced accommodation and businesses providing additional services can require separate tax analysis.

What These Rules Mean in Phuket

Phuket’s rental market contains very different ownership and operating structures.

A tenant may be dealing with a private individual renting one condominium, an investor owning several properties, an apartment operator, a villa owner, a serviced-residence business or accommodation operating within a hotel structure.

Those arrangements should not automatically be treated as legally identical.

One Condominium Owned by a Private Landlord

This is common in Phuket.

The owner may fall outside the three-unit OCPB business threshold.

That does not remove the need for a proper written lease, transparent deposit and utility terms, a condition report and appropriate immigration compliance.

It simply means the specific controlled-contract regime should not automatically be applied without first checking the landlord’s status.

Multiple Units Operated as a Rental Business

An owner or operator offering three or more residential rental units requires much closer attention to the OCPB regime.

Contract language, Thai-language requirements, deposits, billing, utility charges, repairs and termination clauses should be checked against the current rules.

Villas

Villa leases can involve larger deposits, expensive furnishings, pools, gardens and substantial potential repair costs.

A detailed inventory, photographic condition report and clear division of maintenance responsibilities are particularly important.

Long-Term Leasehold Property

Where a property lease extends beyond three years, registration becomes a central legal issue.

The wording printed in the contract is not the only consideration.

The parties also need to determine whether the transaction has been properly registered at the Land Office.

Serviced and Short-Stay Accommodation

Properties providing hotel-like or short-term accommodation can involve a different regulatory analysis from ordinary residential tenancies.

Investors should not assume that residential leasing, condominium regulations and hotel operations are interchangeable.

These distinctions are particularly important when purchasing Phuket property primarily for rental use.

Practical Rental Checks Before Signing

Whether acting as landlord or tenant, several basic checks can prevent disproportionate problems later.

Confirm the identity of the legal landlord.

Determine whether the landlord operates enough residential units to potentially fall within the controlled-contract regime.

Confirm the rent, security deposit, advance rent, utilities and recurring charges in writing.

Document the condition of the property before possession changes hands.

Keep evidence of rental and deposit payments.

Understand termination provisions before signing.

For leases exceeding three years, confirm whether Land Office registration is required.

Where a foreign tenant will occupy the property, ensure the relevant TM30 obligation is addressed.

For landlords receiving rental income, clarify the tax position rather than relying on a generic rental-tax percentage.

JFTB’s role in rental and property transactions is commercial and practical. Legal, immigration and tax questions requiring professional determination should be referred to qualified independent advisers.

Common Misunderstandings About Thailand Rental Law

“Every landlord can only ask for three months upfront.”

Not necessarily.

The combined three-month restriction applies within the relevant OCPB controlled-contract framework and includes both security deposit and advance rent.

Certain qualifying long-term contracts with annual payments are treated differently.

“A two-month security deposit is illegal in Thailand.”

Not as a universal rule.

The applicable regime and structure of the tenancy must be identified first.

“A signed 10-year lease automatically protects the tenant for 10 years.”

Not necessarily.

A lease of immovable property exceeding three years generally requires Land Office registration if it is intended to be enforceable beyond the first three years.

“A 30+30+30 lease is the same as a registered 90-year lease.”

No.

Thailand’s ordinary framework generally allows a maximum registered lease term of 30 years per term.

Any promises concerning future renewal should be analysed separately.

“The landlord can charge any electricity rate stated in the contract.”

Not where the controlled OCPB regime applies.

Qualifying operators are subject to restrictions on utility charges.

Frequently Asked Questions About Thailand Rental Law

What changed in Thailand’s rental law in 2025?

New OCPB controlled-contract rules took effect on 4 September 2025.

One major change reduced the qualifying threshold for residential rental business operators from five units to three.

The framework also introduced or strengthened requirements covering contracts, deposits, billing, utilities, repairs and termination.

Do the OCPB rental rules apply to someone renting one condo?

Not automatically.

A private owner renting a single condominium does not fall within the controlled-business regime solely because the unit is rented.

General Thai law and the lease itself still apply.

What is the maximum rental deposit in Thailand?

There is no single universal deposit figure applicable to every landlord.

Within qualifying OCPB monthly rental arrangements, the combined security deposit and advance rent generally cannot exceed three months’ rent.

Other structures can require different treatment.

How quickly should a deposit be returned?

For qualifying controlled contracts, the deposit should generally be returned within seven days where no tenant-caused damage exists.

Where legitimate repair deductions are necessary, the remaining balance should generally be returned within 14 days.

Does a regulated residential lease need to be in Thai?

Qualifying contracts under the 2025 OCPB regime must contain clearly legible Thai-language text meeting the notification’s formatting requirements.

Foreign landlords using English-only lease templates should therefore check whether the regime applies to them.

Can a tenant terminate a fixed-term lease early?

Under qualifying controlled contracts, tenants may have a specific early-termination right after occupying the property for at least half of the agreed term, subject to at least 30 days’ written notice and payment requirements.

This does not automatically apply to every private tenancy.

Does a lease longer than three years need registration?

A lease of immovable property exceeding three years generally needs Land Office registration if it is intended to be enforceable beyond the first three years.

What is the usual maximum lease term in Thailand?

Under the ordinary Civil and Commercial Code framework, the standard maximum registered lease term for immovable property is generally 30 years per term.

Does a Phuket landlord need to file a TM30 for a foreign tenant?

Where the requirements under Section 38 of Thailand’s Immigration Act apply, the relevant house owner, householder, landlord or accommodation operator must generally report the foreign national’s residence to immigration within 24 hours of arrival.

Is rental income taxable in Thailand?

Yes.

Rental income is generally assessable under Thailand’s Revenue Code.

The actual liability depends on the landlord, tax residence, payer, deductions, withholding requirements and other circumstances.

Thailand Rental Law 2026: Key Takeaways

Thailand’s rental framework cannot be reduced to one deposit rule, one tax percentage or one standard lease.

The first step is to identify the rental structure and the status of the landlord.

For qualifying residential rental businesses offering three or more units, the OCPB controlled-contract rules impose important requirements concerning contracts, Thai-language documentation, deposits, utilities, billing, repairs and termination.

For private landlords outside that regime, general Thai contract and property law remain relevant.

For leases longer than three years, Land Office registration becomes particularly important.

Foreign tenants can also trigger separate TM30 immigration reporting obligations for the relevant landlord or accommodation provider.

For landlords receiving rental income, tax and stamp-duty obligations should be considered separately from the lease terms and separately from the property’s actual investment return.

For Phuket owners and tenants, the practical lesson is straightforward:

Identify which rules apply before relying on the wording of the lease.

A signed contract matters, but a signature alone does not make every contractual clause enforceable.

Thailand rental law in 2026 is therefore best understood as a combination of consumer-protection rules, contract law, lease-registration requirements and related compliance obligations.

<h2 Thailand’s Office of the Consumer Protection Board, including the 2025 controlled-contract framework and subsequent enforcement information.

Lease-registration and maximum-term references are based on Thailand’s Civil and Commercial Code framework and guidance from the Department of Lands.

TM30 information is based on Section 38 of Thailand’s Immigration Act and official Thai Immigration Bureau guidance.

Tax and stamp-duty references are based on materials published by the Thai Revenue Department, including the treatment of rental income under Section 40(5), expense deductions, withholding provisions and the official stamp-duty schedule.

Analysis from <a href="https://www.tilleke.com/insights/thailand-strengthens-controls-on-residential-lease-contracts/" legislation, administrative interpretation and tax rules can change, landlords, tenants and investors should verify the current position before relying on this guide for a specific transaction.

<p
